S. Department of Housing and Urban Development in the total amount of $15,027,206.00 and appropriated $16,854,300.00 for various projects, to re-appropriate $11,034.83 from recaptured ESG-CV funds, for the purpose of providing funds to Emergency Shelter, Inc., doing business as Home Again, for homeless men and family shelters.

THE CITY OF RICHMOND HEREBY ORDAINS:

 

I.                     That Ordinance No. 2019-188, adopted July 22, 2019, as previously amended by Ordinance No. 2020-094, adopted May 11, 2020, Ordinance No. 2021-268, adopted October 11, 2021, and Ordinance No. 2022-300, adopted November 7, 2022, be and is hereby amended and reordained as follows:

§ 1.                     That the Chief Administrative Officer for, and on behalf of the City of Richmond, be and is hereby authorized and directed to submit a revised Annual Action Plan for fiscal year 2019-2020 entitled “City of Richmond, VA, Fiscal Year 2020 Consolidated Annual Action Plan, Amendment 1, Department of Housing and Community Development,” and dated March 1, 2020, to the United States Department of Housing and Urban Development, in the form of the document attached to Ordinance No. 2020-094, adopted May 11, 2020, as an amended application for the receipt of Community Development Block Grant (CDBG) funds, HOME Investment Partnership (HOME) funds, Emergency Solutions Grant (ESG) funds and Housing Opportunities for Persons with AIDS (HOPWA) funds and to accept funds in the total amount of $7,480,634.00 ($4,462,031.00 - CDBG; $1,455,440.00 - HOME; $376,954.00 - ESG; and $1,186,209.00 - HOPWA) from the United States Department of Housing and Urban Development, as specified in the revised 2019-2020 annual budget plan identified as Attachment [B] A, a copy of which is attached to and incorporated into this amendatory ordinance.

                     § 2.                     That the funds in the total amount of $9,307,728.00, comprised of such grants from the United States Department of Housing and Urban Development in the total amount of $7,480,634.00 together with $1,138,581.00 in prior year surplus from CDBG funds $250,000.00 in prior year surplus from HOME funds, $50,050.00 in prior year surplus from ESG funds, and $388,463.00 in program income from CDBG funds, are hereby appropriated to the Special Fund Budget for the fiscal year commencing July 1, 2022, and ending June 30, 2023, for the purposes set forth on the revised Attachment [B] A, a copy of which is attached to and incorporated into this amendatory ordinance.

§ 3.                     This ordinance shall be in force and effect upon adoption.

II.                     That Ordinance No. 2020-164, adopted August 10, 2020, as previously amended by Ordinance No. 2020-191, adopted September 28, 2020, Ordinance No. 2021-089, adopted April 26, 2021, Ordinance No. 2021-184, adopted July 26, 2021, [and] Ordinance No. 2021-268, adopted October 11, 2021, and Ordinance No. 2022-300, adopted November 7, 2022, be and is hereby amended and reordained as follows:

                     § 1.                     That the Chief Administrative Officer for, and on behalf of the City of Richmond, be and is hereby authorized and directed to submit an amended version of the Fiscal Year 2020  Annual Action Plan attached to Ordinance No. 2021-089, adopted April 26, 2021, to the United States Department of Housing and Urban Development, as an amendment to the Annual Action Plan for fiscal year 2019-2020 attached to Ordinance No. 2019-188, adopted July 22, 2019, as amended by Ordinance No. 2020-094, adopted May 11, 2020, Ordinance No. 2020-164, adopted August 10, 2020, Ordinance No. 2020-191, adopted September 28, 2020, Ordinance No. 2021-089, adopted April 26, 2021, [and] Ordinance No. 2021-268, adopted October 11, 2021, and Ordinance No. 2022-300, adopted November 7, 2022, and in the form of the document described as the “[6th] 7th COVID-19 Amendment” and dated [October 13, 2022] May 15, 2023, attached to this amendatory ordinance and identified as Attachment [C] B, for the receipt of Community Development Block Grant (CDBG) funds, HOME Investment Partnership (HOME) funds, Emergency Solutions Grant (ESG) funds and Housing Opportunities for Persons with AIDS (HOPWA) funds and to accept funds in the total amount of $7,546,572.00 ($4,045,895.00 - CDBG-CV; $3,306,232.00 - ESG-CV; and $194,445.00 - HOPWA-CV) from the United States Department of Housing and Urban Development, as specified in the document entitled “Revised PY2019-2020 Annual Action Plan Budget” and identified as Attachment [B] A, a copy of which is attached to and incorporated into this amendatory ordinance.

                     § 2.                     That the funds in the total amount of $7,546,572.00 comprised of such grants from the United States Department of Housing and Urban Development in the total amount of $7,546,572.00, are hereby appropriated to the Department of Housing and Community Development’s Special Fund Budget for the fiscal year commencing July 1, 2022, and ending June 30, 2023, for the purposes set forth on Attachment [B] A.

§ 3.                     This ordinance shall be in force and effect upon adoption.

III.                     This amendatory ordinance shall be in force and effect upon adoption.

RE:                     Request to Amend the FY2019-2020 Annual Action Plan and Budget for the HUD Entitlement ESG-CV Allocation and Appropriate $11,034.83 in Recaptured ESG-CV Funds to Emergency Shelter, Inc. (dba HomeAgain).

PURPOSE: To authorize and direct the Chief Administrative Officer to submit a revised Fiscal Year 2020 (PY2019) Annual Action Plan of the City’s Five Year (2016-2020) Consolidated Plan in the form of the documents attached to this O&R request and identified as Attachment A and Attachment B, and to authorize and appropriate the $11,034.83 in recaptured ESG-CV funds to Emergency Shelter, Inc. (dba HomeAgain).

 

REASON: The US Department of Housing and Urban Development previously awarded ESG-CV funding to the City of Richmond. This money was accepted and awarded to approved projects, Emergency Shelter, Inc. (dba HomeAgain) was one of the previously approved projects. Several of the other approved projects (Homeward, Caritas, Side-By-Side, and the Daily Planet) had nominal amounts of remaining funds that were recaptured. City Administration is proposing that the $11,034.83 recaptured be reallocated to Emergency Shelter, Inc. (dba HomeAgain) for its shelter operations, including personnel expenses.  The City is proposing to award the recaptured ESG-CV funds to a project that will help to meet the ongoing need to provide shelter for low and very low-income individuals who are homeless.  Most importantly, the proposed project will assist in mitigating the spread of COVID and various post-COVID variants among the City of Richmond’s unsheltered residents.

 

RECOMMENDATION: Approval is recommended by the City Administration.

 

BACKGROUND: This 2020 Fiscal Year ESG-CV allocation was authorized by the Coronavirus Aid Relief and Economic Security Act (Cares Act), Public Law 116-136. If recaptured funds are to be reallocated, the proposed amendment of the Annual Action Plan is required by HUD. The City of Richmond is allowed by HUD to amend its PY2019/FY2020 Annual Action Plan to include the new activities that will be funded with the remaining or recaptured ESG-CV funds.

 

The Housing and Community Development Department is proposing to award additional funding to Emergency Shelter, Inc. (dba HomeAgain) for shelter operations to include salary expenses for personnel who are providing direct services to the City of Richmond homeless residents. The proposed funds to be awarded were recaptured from projects that did not spend all of their ESG-CV funding, including Homeward, Caritas, Side-By-Side, and the Daily Planet. The proposed award to Emergency Shelter, Inc. (HomeAgain) will be an increase in funding as Emergency Shelter, Inc. was previously awarded ESG-CV funds. The proposed amendment to the PY2019/FY2020 Annual Action Plan and corresponding budget and the new award to Emergency Shelter, Inc., (dba HomeAgain) requires the approval of the City Council.

 

The allocation of the recaptured ESG-CV funds is outlined below:

Total ESG-CV allocation:  $11,034.83

 

Project:

 

1.                     Shelter Operations, including personnel expenses (Emergency Shelter, Inc.  (dba HomeAgain) - allocated an increase of $11,034.83 for shelter operations at their men and family shelters.

 

FISCAL IMPACT/COST:  No negative impact. The requested funds are available for appropriation.

 

FISCAL IMPLICATIONS:  The appropriation of the City’s HUD Federal Entitlement and recaptured funding will enable the City to carry out the shelter activities as outlined in the previously amended PY2019/FY2020 Annual Action Plan (AAP) and the proposed amendment of the PY2019/FY2020 Annual Action Plan Budget.

 

BUDGET AMENDMENT NECESSARY:  No

 

REVENUE TO CITY: There is no new revenue to the City.
