THE CITY OF RICHMOND HEREBY ORDAINS:

WHEREAS, section 27-279 of the Code of the City of Richmond (2015), as amended, establishes criteria and procedures for the establishment of residential permit parking districts in the City; and

                     WHEREAS, growth and development in the Historic Jackson Ward neighborhood of the City has created additional needs for parking that impedes neighborhood residents from parking in parking spaces within close proximity to their homes; and

                     WHEREAS, the Council hereby desires to establish a residential permit parking district in the Historic Jackson Ward neighborhood in accordance with section 27-279 of the Code of the City of Richmond (2015), as amended.

THE CITY OF RICHMOND HEREBY ORDAINS:

                     § 1.                     That the City hereby establishes the Historic Jackson Ward Residential Permit Parking District (the “District”) to exist and be maintained in accordance with the following provisions:

A.                     Streets.  The following streets and portions of streets where curb parking is otherwise legally permitted shall be a part of the District:

a.                     Both sides of the 00 block of East Clay Street between St. James Street and North 1st Street.

b.                     Both sides of the 100 block of East Clay Street between North 1st  Street and North 2nd Street.

c.                     Both sides of the 00 block of West Clay Street between North Adams Street and St. James Street.

d.                     Both sides of the 100 block of West Clay Street between Brook Road and North Adams Street.

e.                     Both sides of the 200 block of West Clay Street between Brook Road and North Adams Street.

f.                     Both sides of the 300 block of West Clay Street between North Monroe Street and North Madison Street.

g.                     Both sides of the 400 block of West Clay Street between North Henry Street and North Monroe Street.

h.                     Both sides of the 500 block of North 1st Street between East Clay Street and East Leigh Street.

i.                     West side of the 700 block of North 1st Street between East Jackson Street and East Duval Street.

j.                     Both sides of the 500 block of St. James Street between East and West Clay Streets and East and West Leigh Streets.

k.                     Both sides of the 600 block of St. James Street between East and West Leigh  Streets and East and West Jackson Streets.

l.                     South side of the 400 block of Catherine Street between North Henry Street and North Monroe Street.

m.                     South side of the 500 block of Catherine Street between Smith Street and North Henry Street.

n.                     Both sides of the 400 block of North Henry Street between West Clay Street and West Marshall Street.

o.                     Both sides of the 500 block of North Henry Street between Catherine Street and West Clay Street.

p.                     Both sides of the 500 block of North Monroe Street between Catherine Street and West Clay Street.

B.                     Conditions.  The following conditions shall apply to all on-street parking in the District:

1.                     A two-hour parking time limit shall exist on the block faces as set forth in subsection (A) above from 7:00 a.m. to 10:00 p.m., Sunday through Thursday, and from 7:00 a.m. to 12:00 a.m., Friday and Saturday, except for vehicles displaying a valid permit.  The signs governing this regulations shall read “Two Hour Parking 7:00 A.M. to 10:00 P.M. Sunday Thru Thursday and 7:00 A.M. to 12:00 A.M., Friday and Saturday - Except by Valid Permit.”

2.                     To be eligible to obtain the permit to which subsection (B)(1) above refers, a person must comply with all of the following conditions:

a.                     Persons who legally reside on the streets set forth in subsection (A) above and have a motor vehicle must register the vehicle in accordance with the requirements of the Virginia Department of Motor Vehicles.  If the Department of Motor Vehicles requires the vehicle be registered in the City of Richmond, all City taxes and fees that are due must be paid prior to obtaining a parking decal.

b.                     Renters and students must provide a valid written lease for the property located in the Historic Jackson Ward neighborhood and comply with the vehicle registration requirements indicated below to be eligible to obtain a parking decal.

c.                     All residents in the Historic Jackson Ward Residential Permit Parking District Program must display the decal in the lower right corner of the rear window of their vehicle.  All expired decals must be removed from the windshield.

3.                     Guests will be in violation and may be ticketed and towed if a current visitor’s pass is not properly displayed.

4.                     Historic Jackson Ward neighborhood residents must present a picture identification or another form of identification that enables the Department of Public Works to verify their identities.

C.                     Permits.  Historic Jackson Ward Residential Permit Parking District Decals and Annual Visitor’s Passes governed by this section shall constitute evidence of the permit required by subsection (B) above for parking in the District.  The following provisions shall govern the issuance of Historic Jackson Ward Residential Permit Parking District Decals and Annual Visitor’s Passes:

1.                     Historic Jackson Ward Residential Permit Parking District Decals shall be available to eligible persons for a fee of $25.00 each.  No more than three Historic Jackson Ward Residential Permit Parking District Decals per household shall be permitted.  Each Historic Jackson Ward Residential Permit Parking District Decal shall expire annually on August 31.  A Historic Jackson Ward Residential Permit Parking District Decal purchased for a vehicle that was sold or otherwise disposed of by the owner may be purchased for $1.00 with verification of the original Historic Jackson Ward Residential Permit Parking District Decal purchase and vehicle information from the Department of Motor Vehicles.

2.                     Annual Visitor’s Passes shall be available to eligible persons for a fee of $35.00 each.  No more than two Historic Jackson Ward Residential Permit Parking District Visitor’s Passes per homeowner shall be permitted.  The Annual Visitor’s Passes must be purchased at the same time as the Historic Jackson Ward Residential Permit Parking District Decals.  Each Visitor’s Pass shall expire annually on August 31.  The Annual Visitor’s Pass may not be replaced.

§ 2.                     This ordinance shall be in force and effect on the ninetieth day after the date on which this ordinance is adopted.
