To impose enhanced speeding penalties pursuant to City Code § 27-163 and to authorize the placement of signs giving notice thereof on the portion of Evansway Lane located between Whitehorse Road and Westgate Drive, the portion of Cedar Grove Road located between Westgate Drive and Pondera Road, and the portion of Croatan Road located between Pondera Road and Apache Road.

WHEREAS, pursuant to section 46.2-878.2 of the Code of Virginia (1950), as amended, section 27-163 of the Code of the City of Richmond (2015), as amended, provides for the imposition of enhanced speeding penalties for operation of a motor vehicle in excess of the maximum speed limit on certain residential streets; and
WHEREAS, in accordance with section 27-163 of the Code of the City of Richmond (2015), as amended, the City has determined that the 85th percentile speed on the portion of Evansway Lane located between Whitehorse Road and Westgate Drive, the portion of Cedar Grove Road located between Westgate Drive and Pondera Road, and the portion of Croatan Road located between Pondera Road and Apache Road is at least ten miles per hour greater than the posted speed limit; and
WHEREAS, the Council Member representing the Council District in which the portion of Evansway Lane located between Whitehorse Road and Westgate Drive, the portion of Cedar Grove Road located between Westgate Drive and Pondera Road, and the portion of Croatan Road located between Pondera Road and Apache Road are situated has submitted a written request for the application of the provisions of section 27-163 of the Code of the City of Richmond (2015), as amended; and
WHEREAS, it is in the best of interests of the citizens of the City of Richmond, especially those who reside on or near the portion of Evansway Lane located between Whitehorse Road and Westgate Drive, the portion of Cedar Grove Road located between Westgate Drive and Pondera Road, and the portion of Croatan Road located between Pondera Road and Apache Road, that the City Council authorize the placement of signs on such portion of Evansway Lane located between Whitehorse Road and Westgate Drive, such portion of Cedar Grove Road located between Westgate Drive and Pondera Road, and such portion of Croatan Road located between Pondera Road and Apache Road in order to implement the enhanced speeding penalties for which section 27-163 of the Code of the City of Richmond (2015), as amended, provides;
NOW, THERFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF RICHMOND:
That the placement of signs indicating the application of enhanced speeding penalties pursuant to section 46.2-878.2 of the Code of Virginia (1950), as amended, and section 27-163 of the Code of the City of Richmond (2015), as amended, on the portion of Evansway Lane located between Whitehorse Road and Westgate Drive, the portion of Cedar Grove Road located between Westgate Drive and Pondera Road, and the portion of Croatan Road located between Pondera Road and Apache Road is hereby authorized in accordance with section 27-163(b)(3) of the Code of the City of Richmond (2015), as amended, with such signs to be placed no later than 45 days after the date on which this resolution is adopted.
