THE CITY OF RICHMOND HEREBY ORDAINS:

I.                     That Ordinance No. 2007-251-209, adopted September 24, 2007, as previously amended by Ordinance No. 2008-117-93, adopted May 27, 2008, Ordinance No. 2013-117-113, adopted June 24, 2013, and Ordinance No. 2016-264, adopted December 11, 2017, be and is hereby amended and reordained as follows:                     

WHEREAS, section 27-279 of the Code of the City of Richmond [(2015)] (2020), as amended, establishes criteria and procedures for the establishment of residential permit parking districts in the City; and

                     WHEREAS, growth and development in the Carver neighborhood of the City has created additional needs for parking that impedes neighborhood residents from parking in parking spaces within close proximity to their homes; and

                     WHEREAS, the Council hereby desires to establish a residential permit parking district in the Carver neighborhood in accordance with section 27-279 of the Code of the City of Richmond [(2015)] (2020), as amended.

THE CITY OF RICHMOND HEREBY ORDAINS:

                     § 1.                     That the City hereby establishes the Carver Residential Permit Parking District (the “District”) to exist and be maintained in accordance with the following provisions:

A.                     Streets.  The following streets and portions of streets where curb parking is otherwise legally permitted shall be a part of the District:

1.                     Both sides of the 1400 block of West Clay Street between Bowe Street and Kinney Street.

2.                     Both sides of the 1300 block of West Clay Street between Kinney Street and Norton Street.

3.                     North side of the 1200 block of West Clay Street between Norton Street and Harrison Street.

4.                     Both sides of the 1100 block of West Clay Street between Harrison Street and Hancock Street.

5.                     Both sides of the 1000 block of West Clay Street between Hancock Street and Goshen Street.

6.                     Both sides of the 900 block of West Clay Street between Hancock Street and Goshen Street.

7.                     North side of the 800 block of West Marshall Street.

8.                     North side of the 1000 block of West Marshall Street.

9.                     North side of the 1100 block of West Marshall Street.

10.                     Both sides of the 400 block of Hancock Street between West Marshall Street and West Clay Street.

11.                     Both sides of the 500 block of Hancock Street between Catherine Street and West Clay Street.

12.                     Both sides of the 600 block of Hancock Street between Catherine Street and West Leigh Street.

13.                     West side of the 800 [block] and 900 blocks of North Harrison Street between West Clay Street and West Leigh Street.

14.                     Both sides of the 800 block of Kinney Street between West Clay Street and Catherine Street.

15.                     Both sides of the 900 block of Kinney Street between West Leigh Street and Catherine Street.

16.                     South side of the 1400 block of West Leigh Street between Bowe Street and Kinney Street.

17.                     South side of the 1200 block of West Leigh Street between Norton Street and North Harrison Street.

18.                     North side of the 700 block of West Catherine Street between Gilmer Street and Munford Street.

19.                     South side of the 700 block of West Catherine Street between Gilmer Street and Munford Street.

20.                     North side of the 800 block of West Catherine Street between Goshen Street and Gilmer Street.

21.                     South side of the 800 block of West Catherine Street between Goshen Street and Gilmer Street.

22.                     Both sides of the 900 block of West Catherine Street between Hancock Street and Goshen Street.

23.                     Both sides of the 1000 block of West Catherine Street between Hancock Street and Goshen Street.

24.                     West side of the 500 block of Munford Street.

25.                     West side of the 600 block of Munford Street.

26.                     East side of the 600 block of Gilmer Street.

27.                     West side of the 500 block of Goshen Street.

28.                     West side of the 600 block of Goshen Street.

29.                      East side of the 400 block of Gilmer Street between West Marshall Street and West Clay Street.

30.                     East side of the 500 block of Gilmer Street between West Clay Street and Catherine Street.

31.                     Both sides of the 800 block of West Clay Street between Goshen Street and Gilmer Street.

32.                     Both sides of the 700 block of West Clay Street between Gilmer Street and Munford Street.

33.                     West side of the 400 block of Munford Street between West Clay Street and West Marshall Street.

34.                     Both sides of the 1200 block of Catherine Street between Norton Street and North Harrison Street.

35.                     Both sides of the 1100 block of Catherine Street between North Harrison Street and Hancock Street.

B.                     Conditions.  The following conditions shall apply to all on-street parking in the District:

1.                     [A parking time limit, set by the Department of Public Works and posted with appropriate signs, shall exist on the block faces as set forth in paragraph one above from 7:00 a.m. to 12:00 a.m., Monday through Saturday, except for vehicles displaying a valid permit.] Parking time limits, which may vary by block and which the Department of Public Works shall set and post using appropriate signs, shall apply throughout the District from 7:00 a.m. to 12:00 a.m., Monday through Saturday, but no such time limit shall apply to a vehicle that properly displays any of the following, each as further described in subsection C below: (i) a valid and current District parking permit in the form of, and hereinafter described as, a Carver Decal, (ii) a valid annual visitor’s parking pass, or (iii) a valid employee parking pass.

2.                     [The following persons shall be eligible to obtain the permit to which subsection B(1) above refers.

a.                     Persons who legally reside on the streets set forth in subsection (A) above and have a motor vehicle must register the vehicle in accordance with the requirements of the Virginia Department of Motor Vehicles.  If the Department of Motor Vehicles requires the vehicle be registered in the City of Richmond, all City taxes and fees that are due must be paid prior to obtaining a parking decal.

b.                     Renters and students must provide a valid written lease for the property located in the Carver neighborhood and comply with the vehicle registration requirements indicated below to be eligible to obtain a parking decal.

c.                     All residents in the Carver Residential Permit Parking Program must display the decal in the lower right corner of the rear window of their vehicle.  All expired decals must be removed from the windshield.] Any person found to have parked a vehicle without a valid and properly displayed Carver Decal, annual visitor’s parking pass, or employee parking pass within the District for a time in excess of a posted parking time limit shall be subject to the penalty described in section 27-218(b)(3) of the Code of the City of Richmond (2020), as amended.

3.                     [Guests will be in violation and may be ticketed and towed if a current visitor’s pass is not properly displayed.

                     4.                     Carver residents must present a picture identification or another form of identification that enables the Department of Finance to verify their identities.Parking in the District shall be subject to the terms of this Ordinance and other applicable law. To the extent the terms of this Ordinance may conflict with section 27-280 of the Code of the City of Richmond (2020), as amended, the terms of this Ordinance shall control.

C.                     [Decals.  Carver Decals and Annual Visitor’s Passes governed by this section shall constitute evidence of the permit required by subsection (B) above for parking in the District.  The following provisions shall govern the issuance of Carver Decals and Annual Visitor’s Passes:Permit and Pass Eligibility.

1.                     [Carver Decals shall be available to eligible persons for a fee of $25.00 each.  No more than three Carver Decals per household shall be permitted.  Notwithstanding any provision of section 27-280 of the Code of the City of Richmond (2015), as amended, to the contrary, each Carver Decal shall expire annually at 12:00 midnight on December 31.  A Carver Decal purchased for a vehicle that was sold or otherwise disposed of by the owner may be purchased for $1.00 with verification of the original Carver Decal purchase and vehicle information from the Department of Motor Vehicles.Permits.  The following persons may apply for a Carver Decal:

a.                     Any resident, as that term is defined in City Code Section 27-280, of either a single-family dwelling or a two-family dwelling, as those terms are defined in section 30-1220 of the Code of the City of Richmond (2020), as amended, situated along any of the block faces set forth in subsection A above.

b.                     Any legal person who operates a business that (i) is along any of the block faces set forth in subsection A above and (ii) has no dedicated off-street parking spaces, which person may apply for up to two Carver Decals for a fee of $25.00 per decal.

2.                     [Annual Visitor’s Passes shall be available to eligible persons for a fee of $35.00 each.  No more than two Carver Visitor’s Passes per household shall be permitted.  The Annual Visitor’s Pass must be purchased at the same time as the Carver Decals.  Notwithstanding any provision of section 27-280 of the Code of the City of Richmond (2015), as amended, to the contrary, each Visitor’s Pass shall expire annually at 12:00 midnight on December 31. The Annual Visitor’s Pass may not be replaced.Conditions of Permit Issuance.  An applicant for a Carver Decal shall satisfy the following conditions, as well as all applicable conditions set forth in section 27-280 of the Code of the City of Richmond (2020), as amended, prior to receipt of a Carver Decal:

a.                     If applicant is a resident described in paragraph C1(a) above, provide evidence of residence within the District in the form of (i) a valid Virginia driver’s license or voter registration card, or (ii) a valid written lease that demonstrates applicant is a tenant in a qualifying dwelling within the District.

b.                     If applicant is a person described in paragraph C1(b) above, provide evidence of place of business within the District in the form of a valid business license as described section 26-869 of the Code of the City of Richmond (2020), as amended.

3.                     Annual Visitor’s Parking Passes. Any resident described in paragraph C(1)(a) above who receives a Carver Decal may request up to two annual visitor’s parking passes for use in the District, subject to the terms of subsection D(2) below.

4.                     Employee Parking Passes. Any person as described in paragraph C(1)(b) above who provides evidence of place of business within the District in accordance with paragraph 2(b) above may apply for employee parking passes for use in the District. The maximum number of employee parking passes such person may receive shall be equal to the total number of employees at such place of business or six, whichever is less, minus the number of off-street parking spaces dedicated for use by the business.

D.                     Permit and Pass Issuance and Display. In addition to issuance and display rules for restricted parking district permits and annual visitor’s parking passes set forth in section 27-280 of the Code of the City of Richmond (2020), as amended, the following issuance and display rules shall apply to Carver Decals and the passes referenced in subsection B(1) above:

1.                     Permits.

a.                     Possession of a properly displayed Carver Decal shall constitute evidence of the permit for parking in the District required by subsection B(1)(i) above.

b.                     No more than three Carver Decals shall be permitted per family, as that term is defined in section 30-1220 of the Code of the City of Richmond (2020), as amended.

                     c.                     The holder of a Carver Decal may purchase a replacement Carver Decal for $1.00 when:

i.                     The vehicle for which the original Carver Decal was purchased is sold or otherwise disposed of by its owner, and (ii) the holder of the original Carver Decal verifies the purchase thereof and otherwise demonstrates compliance with the terms of this Ordinance.

d.                     A Carver Decal shall only be properly displayed when attached to the lower right corner of the rear window of the vehicle for which it was purchased, and all expired Carver Decals shall be removed from such window.

2.                     Annual Visitor’s Parking Passes.

a.                     Any annual visitor’s parking pass for use in the District shall be requested at the same time as a Carver Decal.

b.                     Every annual visitor’s parking pass for use in the District shall be issued in the form of a placard.

c.                     An annual visitor’s parking pass shall only be properly displayed when placed on the dashboard of an applicable vehicle so as to be visible from outside of the vehicle.

3.                     Employee Parking Passes.

a.                     Every employee parking pass for use in the District shall be issued in the form of a placard on which the name of the applicant’s business is written.

b.                     An employee parking pass shall only be properly displayed when placed on the dashboard of an applicable vehicle so as to be visible from outside of the vehicle.

c.                     Each employee parking pass shall be available to a qualifying applicant for a fee of $35.00.

d.                     An applicant for one or more employee parking passes shall provide evidence to the Department of Public Works sufficient to verify the total number of employees working on-site at applicant’s business and the total number of off-street parking spaces dedicated for use by applicant’s business.

                     e.                     Each employee parking pass shall expire at 11:59 p.m. on December 31 of the calendar year in which such pass is issued.

                     § 2.                     That, notwithstanding any provision of section 27-279 of the Code of the City of Richmond [(2015)] (2020), as amended, to the contrary, the Director of Finance and the Director of Public Works shall have 90 calendar days from the effective date of Ordinance No. 2007-251-209, adopted September 24, 2007, to develop an implementation plan and administer the issuance of the permits as prescribed in this ordinance.

                     § 3.                     This ordinance shall be in force and effect upon adoption.

II.                     This amendatory ordinance shall be in force and effect upon adoption.
