To approve the City of Richmond Plan of Services under the Virginia Juvenile Community Crime Control Act.

WHEREAS, pursuant to section 16.1-309.3(D) of the Code of Virginia (1950), as amended, the governing body of a political subdivision which establishes a community-based system under the Virginia Juvenile Community Crime Control Act (the “Act”) must submit to the State Board of Juvenile Justice for approval a local plan for the development, implementation and operation of such services, programs, and facilities pursuant to the Act; and
WHEREAS, the Department of Justice Services has submitted to the Council of the City of Richmond its plan of services for the Council’s approval as the local plan required by the Act for Fiscal Year 2025-2026;
NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF RICHMOND:
That the Council of the City of Richmond hereby approves the plan of services of the Department of Justice Services of the City of Richmond as the City’s local plan for the development, implementation and operation of the City’s community-based system pursuant to Virginia Juvenile Community Crime Control Act. Such plan of services shall be substantially in the form attached hereto.

PURPOSE: To receive City Council’s endorsement of the local “Plan of Juvenile Services” under the Virginia Juvenile Community Crime Control Act (VJCCCA). This plan covers FY2026 and was developed by the City of Richmond Department of Justice Services and the 13th Judicial District Juvenile Court Service Unit. The plan has been reviewed by the Chief Judge of the Richmond Juvenile and Domestic Relations Court and the Community Policy Management Team (CPMT).
BACKGROUND: In 1995 the General Assembly enacted the Virginia Juvenile Community Crime Control Act (VJCCCA). The purpose of the VJCCCA was to establish a community-based system of progressive sanctions and services that correspond to the severity of offenses and treatment needs of youth before the court system.
COMMUNITY ENGAGEMENT: After introduction, the proposed resolution will be referred to a future Education and Human Services Standing Committee meeting for discussion, where the public is encouraged to attend and provide comments. After the committee’s recommendation to City Council, Council will hold a public hearing regarding the proposed resolution.
STRATEGIC INITIATIVES AND OTHER GOVERNMENTAL: This Resolution is in alignment with Article 12.1.1, Sections 16.1-309.2 - 309.11 of the Code of Virginia, as amended, which states in part:
“Any county, city, or combination thereof may establish a community-based system pursuant to this article, which shall provide, or arrange to have accessible, a variety of pre-dispositional and post-dispositional services. These services may include, but are not limited to, diversion, community service, restitution, house arrest, intensive juvenile supervision, substance abuse assessment and testing, first-time offender programs, intensive individual and family treatment, structured day treatment and structured residential programs, aftercare/parole community supervision, and residential and nonresidential services for juveniles who have been screened for needing community diversion or community-based services using an evidence-based assessment protocol or juvenile offenders who are before intake on complaints or the court on petitions alleging that the juvenile is delinquent, in need of services, or in need of supervision but shall not include secure detention for the purposes of this article. ”
FISCAL IMPACT: The City of Richmond will receive up to $347,683 from the Commonwealth of Virginia Department of Juvenile Justice. The anticipated revenue is included in the adopted FY2026 Justice Services general fund revenue fiscal plan, as adopted by Council on May 12, 2025. As a requirement to receive funding from the Commonwealth of Virginia, $347,683 has been appropriated to the City’s Department of Justice Services’ general fund as the required maintenance of effort amount.
