To authorize the Chief Administrative Officer, for an on behalf of the City of Richmond, to execute certain transportation project agreements between the City of Richmond and the Virginia Department of Transportation to provide funding for various transportation projects in the city of Richmond.

WHEREAS, by Resolution No. 2021-R050, adopted September 27, 2021, and 2023-R032, adopted July 24, 2023, the Council expressed its support for applications for the allocation of funds of up to $10,000,000 through the Virginia Department of Transportation Fiscal Year 2023-2024 and 2025-2026 Revenue Sharing Programs; and
WHEREAS, such funds were requested to fund the construction and maintenance projects set forth on the document entitled “City of Richmond, FY 23-24 VDOT Revenue Sharing Program Project List,” a copy of which is attached to Resolution No. 2021-R050, adopted September 27, 2021, and “City of Richmond, FY 25-26 VDOT Revenue Sharing Program Application Project List,” a copy of which is attached to Resolution No. 2023-R032, adopted July 24, 2023; and
WHEREAS, the City hereby affirms its agreement to commit its share of the total cost for preliminary engineering, right-of-way and construction of the project or projects in accordance with the project financial documents; and
WHEREAS, by Resolution No. 2024-R006, adopted February 26, 2024, the Council expressed its support to request that the Commonwealth Transportation Board provide funding for the City’s SMART SCALE candidate projects for 2024; and
WHEREAS, such funding was requested to fund the construction and maintenance projects set forth on the document entitled “City of Richmond, VA, Smart Scale Program Candidate Project for Round 6,” a copy of which is attached to Resolution No. 2024-R006; and
WHEREAS, by (i) Resolution No. 2023-R034, adopted July 24, 2023, the Council requested that the Commonwealth Transportation Board establish and fund the Cary Street Sidewalk Improvement project, (ii) Resolution No. 2023-R039, adopted July 24, 2023, the Council requested that the Commonwealth Transportation Board establish and fund the Patterson Avenue Bike Lanes project, (iii) Resolution No. 2023-R042, adopted July 24, 2023, the Council requested that the Commonwealth Transportation Board establish and fund the Carnation Street Sidewalk Improvement project, and (iv) Resolution No. 2023-R043, adopted July 24, 2023, the Council requested that the Commonwealth Transportation Board establish and fund the Maymont Neighborhood Sidewalks - Phase III project;
WHEREAS, the City hereby agrees to provide funding for the maintenance and operating costs of the project or projects, unless the City and the Virginia Department of Transportation agree to do otherwise in writing;
NOW, THEREFORE,
THE CITY OF RICHMOND HEREBY ORDAINS:
§ 1. That the Chief Administrative Officer, or the designee thereof, for and on behalf of the City of Richmond, be and is hereby authorized to execute such contracts or other documents with the Virginia Department of Transportation as may be necessary to effectuate the purposes of the transportation projects supported by the Council and set forth in the documents entitled “City of Richmond, FY 23-24 VDOT Revenue Sharing Program Project List,” a copy of which is attached to Resolution No. 2021-R050, adopted September 27, 2021, “City of Richmond, FY 25-26 VDOT Revenue Sharing Program Application Project List,” a copy of which is attached to Resolution No. 2023-R032, adopted July 24, 2023, and “City of Richmond, VA, Smart Scale Program Candidate Project for Round 6,” a copy of which is attached to Resolution No. 2024-R006, adopted February 26, 2024, and the transportation projects supported by the Council set forth in Resolution No. 2023-R034, adopted July 24, 2023, Resolution No. 2023-R039, adopted July 24, 2023, Resolution No. 2023-R042, adopted July 24, 2023, and Resolution No. 2023-R043, adopted July 24, 2023, provided that all such contracts and other documents shall first be approved as to form by the City Attorney, to provide funding for such transportation projects in the city of Richmond.
§ 2. This ordinance shall be in force and effect upon adoption.
