To declare surplus and direct the conveyance of a portion of City-owned real estate on Brown’s Island, located at the south end of the South 5th Street footbridge and consisting of 1,256± square feet in the form of a circle with a diameter of 40 feet, for nominal consideration to the Commonwealth of Virginia for the purpose of facilitating the installation and maintenance of the Emancipation Proclamation and Freedom Monument by the Commonwealth of Virginia, and to repeal Ord. No. 2017-005, adopted Feb. 13, 2017.

THE CITY OF RICHMOND HEREBY ORDAINS:
§ 1. That a portion of City-owned real estate on Brown’s Island, located at the south end of the South 5th Street footbridge, identified as a portion of Tax Parcel No. W000-0072/001 in the 2019 records of the City Assessor, and consisting of approximately 1,256 square feet in the form of a circle with a diameter of 40 feet shown enclosed in a bold line on sheet 1 of 2 of a survey entitled “Plan Showing a Portion of Browns Island Located near the Fifth Street Footbridge,” prepared by Austin Brockenbrough, and dated April 9, 2019, a copy of which is attached to this ordinance, is hereby declared surplus real estate and directed to be conveyed to the Commonwealth of Virginia for nominal consideration, for the purpose of facilitating the installation and maintenance of the Emancipation Proclamation and Freedom Monument by the Commonwealth of Virginia, in accordance with the applicable provisions of Chapter 8 of the Code of the City of Richmond (2015), as amended, the Charter of the City of Richmond (2019), as amended, the Code of Virginia (1950), as amended, and the Constitution of Virginia.
§ 2. That, pursuant to section 8-65(b) of the Code of the City of Richmond (2015), as amended, the Chief Administrative Officer is hereby directed to execute, on behalf of the City, the deed and such other documents, all of which must first be approved as to form by the City Attorney, as may be necessary to consummate the conveyance of the aforementioned portion of City-owned real estate.
§ 3. That Ordinance No. 2017-005, adopted February 13, 2017, is hereby repealed.
§ 4. This ordinance shall be in force and effect upon adoption.
